Domina Law Group pc llo Files Historic Brief in Impeachment Case

David A Domina and Claudia L. Stingfield-Johnson of Domina Law Group pc llo authored and filed the Nebraska Legislature's Brief concerning Impeachment of a Constitutional Officer in the State Supreme Court. Nebraska's unique constitutional process provides that if the Legislature impeaches an official, it becomes Plaintiff in a suit to try the impeachment case in the Nebraska Supreme Court. The entire Court sits, hears all the evidence, and deliberates like a jury on guilt or innocence.

Nebraska's constitutional approach was adopted in 1875 when the State was 8 years old. Since then, the constitutional process has been used twice... in 1984 and 2006. David Domina was intensively involved in both.

In 1984, Domina served as the State's Special Assistant Attorney General. He investigated the role of State government in the failure of an uninsured banking institution. The investigation led to impeachment of the State's Attorney General. Domina was the key witness in the case.

In 2006, Nebraska became the first state to impeach an official for election fraud. The Legislature asked Domina to represent it before the Nebraska Supreme Court. The 2006 case raises novel legal issues about impeachment and election fraud. Domina's brief on this historic issue is among the first things written on the subject.

The Nebraska Supreme Court is scheduled to hear oral argument on Defendant's Motion to Dismiss on Wednesday, May 3, 2006, at 1:30 p.m. This historic occasion marks the first time in the Nation's history oral argument will be heard on an impeachment matter of election fraud.

The Impeachment Trial is scheduled to commence May 8, 2006.
