Trial Date Sought in Suit Against Convicted Bookkeeper

Trial on claims against Kathleen McConnell designed to reach her company's insurance policy was requested in papers filed in U.S. Bankruptcy Court, Western District of Missouri, during October's final week.

"We contend insured fiduciary duties owed by Kathleen McConnell to her company, Professional Business Services, Inc., were breached, and as a result, our client sustained a loss for which Ms. McConnell is liable and for which her insurance is obligated," David Domina said. Domina noted the Bankruptcy Trustee, serving before several cases were consolidated, settled the claims against the bookkeeper who helped complete the largest cattle fraud scheme in U.S. history, but left the claim intact to the extent of any insurance coverage.

Domina said the evidence establishes McConnell was an integral part of fraudulent bookkeeping, used her company Professional Business Services, Inc., to do so, and accordingly, judgment is sought for the full amount available to be recovered under prevailing insurance policies.
