David Domina Quoted by Flatwater Free Press on Pending Suit Against Alvo Village Board

Domina Law Group Founder David Domina has been quoted by the Flatwater Free Press in an article covering the ongoing debacle over a scrap tire operation in Alvo, Nebraska and Domina Law’s pending lawsuit against the Alvo Village Board.

As noted in the article, what began as a dispute from concerned residents over a scrap tire operation that had grown to more than twice the size allowed by Nebraska environmental and fire regulations has spiraled in a “financial and constitutional fiasco.” In addition to prompting a proposed bill in the Nebraska Legislature that aims to prevent similar problems in the future, it also led to a lawsuit filed by David Domina over the improper dealings of the Village Board during a recall election last fall.

According to the lawsuit, which was filed by Domina in October 2021, plaintiffs claim the Village Board voted 5-0 to not call a recall election as required after a petition drive, which was certified by the Cass County Election Office in September, collected enough signatures to force a recall vote on two board members – one a recent owner of the tire scrapyard and the other a Chairman of the board.

As David Domina told the Flatwater Free Press, the board flouted the law with “callous arrogance” for months until a judge’s order forced them to comply in December.

“They have no right, not even arguable right, to refuse to call the election,” Domina said. “You can’t disregard the law. If you don’t like it, you have to change it. Until you change it, you have to obey it.”
