Cody Foster & Co. Sues Urban Outfitters Over Copied Designs

In March, we reported that Cody Foster & Co., a Nebraska-based wholesaler, filed a breach of contract lawsuit against Urban Outfitters and Anthropologie over canceled ornament orders. Now, Cody Foster is suing the retailers over claims that they copied designs without permission.

Brian Jorde, the attorney representing Cody Foster & Co., said that the wholesaler is seeking reimbursement from the sales of the ornaments in question and to halt sale of the ornaments.

Initially, Urban Outfitters and subsidiary company Anthropologie canceled orders of Cody Foster following claims that the Nebraska wholesaler infringed on another artist's work. However, no formal infringement suit was filed against Cody Foster, leaving Urban Outfitters and Anthropologie with no real grounds to lawfully breach contract by canceling orders.

The most recent filing over copied designs amends this previous breach of contract lawsuit.
