Jury Finds Roundup Caused Farmer's Cancer, Thousands of Claims Against Monsanto Now Await

On Tuesday March 19, 2019, a federal jury in California found the world’s most popular weedkiller, Roundup®, was a substantial factor in causing a farmer’s cancer.

The verdict is the first from a federal court in the Roundup litigation, the second in the nation. In August 2018, the first trial over Roundup cancer resulted in California jurors awarding a former school groundskeeper $289 million in compensatory and punitive damages, later reduced to a total $78 million judgment. Both cases set the stage for thousands of similar claims currently pending in state and federal courts.

Tuesday’s verdict was issued in San Francisco, where Roundup claims have been consolidated. While the jury unanimously held Roundup caused blood cancer in a 70-year-old California farmer who used the herbicide on his nearly 60-acre farm, a second phase of the case – which begins Wednesday March 20, 2019 – will focus on whether Monsanto is liable.

UPDATE: On Monday, May 13, 2019, Monsanto was handed its third major loss in California since August when an Oakland jury awarded more than $2 billion in damages to a husband and wife who claimed the Roundup weed killer they used for over 30 years on their properties caused their non-Hodgkin’s lymphoma. The verdict included $55 million in compensatory damages, and $1 billion in punitive damages for each spouse.

The verdict, one of the first of what’s estimated to be over 13,000 pending lawsuits, highlights how juries are viewing the case against Monsanto, which is now owned by Bayer. The company has been accused of concealing risks related to its products by manipulating research, colluding with regulators, and intimidating experts and scientists.
