A jury in Shelby County, TN awarded a $30 million judgement on September
1 against Allenbrooke Nursing and Rehabilitation Center LLC whose
poor care led to the death of a resident back in December of 2009.
The family of Martha Jane Pierce filed the case against the Memphis, TN
nursing home in 2010 after Pierce, who was in hear early 80s at the time,
died after developing pressure sores that later became infected. Pierce
and her husband William shared a room at the nursing home from 2008 to
2009. Pressure sores began to develop on her right foot, and progressed
to the point where they affected her bones as well. Fecal bugs infected
the sores, which required doctors to amputate her leg in October 2009.
Two months after the operation, Pierce died.
Following a five week trial, the jury gave their verdict finding Allenbrooke
Nursing and Rehabilitation Center liable for violations of the Tennessee
Adult Protection Act and negligence. They awarded Pierce’s family
$129,000 for violations of the Protection Act, $1.9 million for negligence,
and $28 million in punitive damages against Allenbrooke Nursing and Rehabilitation
Center, the nursing home’s two owners in New York, and their related
companies. The damages are broken down into $2 million for each of the
four companies, and $10 million each from the owners Norbert Bennett and
Nursing home abuse, whether through neglect, physical abuse, financial abuse, or anything
in between takes advantage of some of the most vulnerable people in the
