On February 20, LexisNexis® in its online publication "Law 360" named Dave Domina and Brian Jorde "legal lions" for their work on the constitutional challenge of L.B. 1161, the statute that was recently declared unconstitutional.
That statute, which was enacted in some haste, was passed in order to facilitate the construction of pipelines, most prominently, TransCanada's Keystone XL pipeline. The statute gave Nebraska Governor Dave Heineman authority to approve the route of KXL, when the Nebraska Constitution gives this right exclusively to the state's Public Service Commission, Domina Law Group contended. The court agreed and ruled the statute unconstitutional on February 19, 2014.
Commenting on their work in this case, Law 360 said,

Stacy sided with a group of landowners who challenged the law, LB 1161, saying it took away the exclusive authority of the state to regulate pipeline routes. Keystone opponents celebrated the ruling, which casts further doubt on the future of the project as it still requires the approval of the Obama administration."
