A medical malpractice claim against a South Dakota Hospital was resolved by settlement, and a jury returned a verdict for a second Defendant, a physician, after trial proceedings completed in October 2005.
Domina Law Group pc llo's 73 year old client, hospitalized for an apparent bleeding ulcer, was discovered to have a large abdominal aortic aneurysm. The patient was discharged with the ulcer stabilized, but the aneurysm in a state indicating a need for surgical intervention.
During the proceedings, the patient's spouse succumbed to cancer and followed her husband in death. "We're pleased to have been able to get this case concluded for our client's surviving children, and be able to help the family know this matter is behind them, said Dave Domina. "We wish the jury's verdict would have supported our position on both claims we filed, but the outcome, with a recovery and opportunity for the family to be heard, is satisfactory."
