The Nebraska Supreme Court’s January 27 decision in Lesiak v. Central Valley Cooperative, 283 Neb 103, ___ NW2d ___ (2012), a nineteen (19)-page Opinion of the Court discloses a high level of understanding about the difficult burden faced by a farmer who seeks to prove crop loss.

First, the Court dealt with the damages issue. It noted that dry land and irrigated land, coarse soils and non-coarse soils, and farms separated by several miles in distance, were involved.

The Federal Sentencing Guidelines, followed by a spate of judicial decisions led by Booker v. U.S., 543 US 220 (2005), led to today’s sentencing practice in the federal judiciary.  The defendant’s sentencing memorandum, a written submission detailing the facts and applying the sentencing guidelines as well as principles of 18 USC § 3553 governing sentencing, to the facts, are standard.  These memoranda are important to sentencing judges. 

Lost in the process in many cases is the role of the final sentencing argument made by the defendant’s lawyer.  Truly, this is the last good chance for the court to be impacted by quality legal service to a needy client.

The taxpayers’ longtime agent advised he had never seen anything like the LOI policy before. He explained it was different because of the ROP Rider provision. It not only returned funds, but allowed the policy holder to self direct the money into an investment and control it, before it was technically returned.

Rozin was concerned about the legitimacy of the policies and the viability of the insurance company. He was assured by advisors the policies were tax deductible and the worst thing that could happen would be a requirement to pay additional taxes plus interest.
