Dave Domina Represents Frenchman Cambridge District in Suit Over Water Diverted to Kansas

This week, the Omaha World Herald published an article covering the Republican River lawsuit of which Domina is representing the plaintiff.

Attorney Dave Domina is representing the Frenchman Cambridge District in a lawsuit involving Republican River water that was diverted to Kansas. The lawsuit does not dispute the compact that allows for the diversion to Kansas; it seeks damages from the state for lost irrigation water from 2013 and 2014. The lawsuit claims that the water was sent to Kansas at the expense of Nebraskans’ crops so that Nebraska could remain compliant with the compact governing water use for that river.

The Nebraska Department of Natural Resources did order water from the Republican River be diverted to Kansas in 2013 and 2014 per the requirements in the compact. By diverting the water to Kansas, the water bypassed irrigation districts in Nebraska – the Frenchman Cambridge District and Bostwick Irrigation District.

Additionally, the Frenchman Cambridge District, represented by Attorney Dave Domina, is suing the Department of Natural Resources and three other resources districts along the Republican River in order to stop plans that could allow for even more groundwater pumping in the basin
