City of Lincoln Likely Extending Backup Assistance to Sewer Victims, Domina Law Group Offers to Help with Potential Legal Claims

Are you one of the Lincoln residents whose residence was flooded with sewer backup on October 1, 2014 or May 6-7, 2015? You may be well aware that the City of Lincoln has set up a disaster assistance program to compensate those affected, but this would only cover up to $5,000 per flooding event and would only compensate for cleanup costs, not replacement or repair expenses.

Although the city initially announced that the application deadline for disaster assistance would be July 15, Mayor Chris Beutler has petitioned to the City Council to push the cutoff back another month to August 15.

The city continues to deny legal claims over the Theresa Street sewer backup, saying that this was no act of negligence, but rather an “act of God” since the backup was prompted by heavy rains.

The City of Lincoln has set aside $1 million for the disaster relief fund, and so far, 70 residents have applied for assistance through the program. Remediation reimbursements (that is, reimbursements for cleanup only) are doled out on a first-come, first-serve basis.
