Heineman Urges High Court to Overturn Ruling on L.B. 1161

Nebraska Governor Dave Heineman is urging the state's high court to overturn the recent ruling on L.B. 1161 so that TransCanada's Keystone XL pipeline project can move forward. In February, Nebraska Judge Stephanie Stacy announced that L.B. 1161, the bill that gave Gov. Heineman authority to approve the pipeline route, was unconstitutional. Due to this ruling, KXL currently has no approval to run through the state of Nebraska.

On April 18, the U.S. State Department announced that it would need more time to evaluate the evidence before they make a decision on the pipeline, in part due to the uncertainty caused by this particular court ruling. According to an article in Businessweek, the soonest the court is likely to hear this case is September.

The article cites both Dave Domina and Brian Jorde, attorneys representing the Nebraska landowners.

"Their argument is nothing new. It is what we already beat them on," said Jorde.
