The Nebraska Supreme Court reinstated a lawsuit against an Omaha man who was convicted of investment fraud against his former attorney. The case, Behrens v. Blunk, involved a lawsuit for over $8 million. Behrens alleged that Blunk poorly advised him and was thereby guilty of securities fraud. The case was dismissed after Behrens pled the Fifth Amendment and wanted to postpone the lawsuit.
The Nebraska Supreme Court stated that the judge was wrong to throw out the lawsuit because Behrens pled the Fifth Amendment. Blunk denies any type of malpractice. Behrens was represented by Attorney David Domina, who was pleased with the court's decision to reinstate the lawsuit. The federal prosecutors allege that Behrens collected over $8 million from investors between the years 2002 and 2007. Those investors were primarily the elderly, according to allegations.
