Mondelli v. Kendel Homes Corp.

With regard to the Mondellis' appeal, we conclude that the district court abused its discretion in excluding the testimony of Drs. Pour and King. This exclusion of evidence was prejudicial error. The district court did not abuse its discretion in refusing to allow joinder of the claims of the Mondelli family.

Compassionate Care Hospice Group Agrees to $2.4 Million Settlement

Compassionate Care Hospice Group has agreed to pay a $2.4 million settlement to resolve allegations that Compassionate Care Group of Atlanta, one of its subsidiaries, paid kickbacks to its physicians in order to encourage them to certify their patients as eligible for hospice services.

“Kickbacks should never play a role in medical decision-making,” said U.S. Attorney John Horn in a Thursday news release announcing the settlement.

According to the lawsuit brought by two former employees and later joined in on by the federal government, the company then billed Medicaid and Medicare for the patients referred. However, by agreeing to the settlement, the company did not admit that they were liable for the actions.

The names of the five physicians accused of receiving the kickbacks were not released in the news release detailing the settlement.
