To Join or Not to Join? Attorney Dave Domina Weighs In for The Progressive Farmer

Attorney Dave Domina was the only lawyer featured in The Progressive Farmer’s recent article on Syngenta MIR 162 lawsuits, specifically touching on whether lawyers want to get involved in this behemoth litigation.

China initially rejected imports of U.S. corn because of the MIR 162 Agrisure Viptera trait. All corn producers between 2011 and 2014, even those who didn’t plant this type of Syngenta corn, may have been affected due to cross-contamination, and all were susceptible to financial losses due to a drop in the nationwide price of corn in response to the temporary loss of the Chinese market.

Attorneys Dave Domina and Brian Jorde toured Nebraska earlier this year and held informational meetings for any farmer, rancher, or Nebraska landowner who may have been affected by Syngenta corn and China’s refusal of U.S. shipments. In the article, Domina explained that he would file his lawsuit against Syngenta in a matter of weeks for individuals who get their information sheets back to him by October 4.

Last week, a federal court rejected Syngenta’s attempt to get these cases dismissed, so the ruling allows lawsuits to go forward, however the federal court also rejected a number of cases against Syngenta as well. Domina stated his belief that many claims were rejected because they were filed by underprepared lawyers who didn’t provide adequate information, about bushel production for example. Domina also stated his belief that other cases were dismissed because lawyers were simply trying to milk the most money out of these cases.
