Florida Rules Noneconomic Damage Caps Are Unconstitutional

Today, the Florida Supreme Court voted to remove caps on noneconomic damages in wrongful death claims, overturning a 2003 law. These caps put limits on how much money the families of wrongful death victims can recover for noneconomic damages such as emotional pain and suffering.

The 2003 law was implemented as part of the Bush tort reforms, but today the Florida Supreme Court rejected this saying that it violations the protection clause of the Florida constitution.
