Intentional Infliction of Emotional Distress Produces Verdict

July, 2004.- Domina Law Group's 40 year old client was sexually assaulted repeatedly as a child. She worked through this travail in therapy, and finally was able to deal with her life by sharing her childhood experience with her father, who was unaware of it.

The perpetrator, a family member, then heard of the disclosures, and threatened the victim through telephone calls and letters.

We filed suit, alleging that the intimidating conduct constituted intention infliction of emotional distress. Though virtually no special damages could be proven, a Nebraska jury agreed in July, 2004 on a verdict for $150,000. Holding that the inappropriate conduct had caused emotional distress, and despite limited objective financial consequences, the jury decided the victim would be compensated appropriately.
