Mondelli v. Kendel Homes Corp.

With regard to the Mondellis' appeal, we conclude that the district court abused its discretion in excluding the testimony of Drs. Pour and King. This exclusion of evidence was prejudicial error. The district court did not abuse its discretion in refusing to allow joinder of the claims of the Mondelli family.

Former Agents Sue Life Insurer For False Promises

Four former Managing General Agents of Woodmen Accident & Life Insurance Company, Lincoln, Nebraska filed suit in U.S. District Court in Omaha against Woodmen and its senior executives, Tuesday, August 5th. The suit claims that the four were victims of wrongful termination, misrepresentation, and other legal misconduct. They claim these wrongful acts occurred when the company terminated its career agents program choosing, to go to strict brokerage sales.

David Domina, Omaha, attorney for the Plaintiffs said, “Company documents are replete with assurances that Woodmen was committed to a ‘career agent’s program.’ In fact, its executives told the sales force that the Company’s career agency program was intact just weeks before it abruptly terminated the program in the summer of 2002.”

The case, filed in U.S. District Court at Omaha NE as Case No. 8:03 CV 305, was assigned to Hon. Joseph Bataillon, U.S. District Judge.

The Complaint, written by David Domina, Richard Hitz and Nora Kane of Domina Law Group details a sequence of events, over several years, in which the Plaintiffs contend affirmative assurances and representations were given to them promising that their “career contracts” with Woodmen were intact, safe, and a permanent part of Woodmen’s sales planning for the future.
